A. Any police officer, along with any code enforcement officer, is authorized to enforce the provisions of this section.

B. Any solicitor or solicitor business who violates any provision of this article shall be first given a written warning or “notice of violation” and an opportunity to come into compliance. A subsequent violation of the same provision of this article shall be charged as a civil offense and is subject to a mandatory minimum fine of $500.00. Any solicitor or solicitor business committing the same offense within five years of being found guilty of a civil offense shall be charged with a class 1 misdemeanor, and, upon conviction, shall be punished by a fine not to exceed $2,500 or by imprisonment for a period not to exceed six months, or by such fine and imprisonment. Probation for any criminal offense may be imposed in accordance with the provisions of A.R.S. Title 13, Chapter 9.

C. Violations of any and all of the provisions in this article shall be considered separate and distinct offenses.
